What to do when a competitor owns your .com name?

Hello guys,

I was wondering if you guys had everyone run into issues where you've bought a .net domain and built it up meaning to also buy the .com name from whoever owned it, only to have it bought up by a competitor?

Well that's happened to me, and now he is redirecting the .com name to his site and there doesn't seem much I can do.

I was thinking about trademarking the name and then when I do have legal rights to the name I could tell him to stop redirection. Is this a plan I should go with?

I would suggest that you run that by an attorney before you go thru the expense of trademarking it. But the thought occurs to me that IF they were actively using that domain BEFORE you actually trademarked it, they might possibly win.

BUT ... In today's world anything can happen! Wink

Hello Rick,

It is the case that it was bought after we had already had our .net running for about a month. Also, the thing is that they are actively building on the .com site but is instead redirecting it to their own site.

Attornies are expensive but I will see if I can get some free counsel. Also, I hear that it only cost $300 to trademark a name? Am I right?

Hi there,

Sorry to hear you missed out on buying the .com name, but I have to say that you probably won't be able to get the .com, unfortunately. I don't really see that you have any legal standing but do please get legal advice and find out.

I buy a lot of domain names, and I'm sure the person who bought the .com name didn't have a clue you'd bought a .net or built a site Smile they probably had no need to search for that.

I come up with great domain names all the time, and I buy them whenever I think of them. As I'd never thought of buying a .net, I have never searched for one.

Perhaps the lesson to be learned is that if you seriously want to own a .com, and it's available, then buy it. That's the only way to get the name you want.

Have you thought of coming up with a new .com name [which might be even better than your .net name], and redirecting your .net to your new .com? Maybe this is a blessing in disguise.

Well to be honest when I register a domain I register it on all... .net, .org, .com, .info, .name...all...once I can afford it...only if you have a copyright...can you really take it from him...or her.

I always am cautious not to register a name under another extension if that name is taken. You can get into legal issues. That aside I would be afraid that people would locate the other business rather than me. So in a case like this I try to think of a new name to fit my business/website.
